What is a planning obligation? Section 106 agreements are used to offset the impact of development on the local sector. They are used when the effects are so severe that they cannot be mitigated by conditions related to a decision to approve the plan. Planning obligations may be preconditions for granting a building permit, although not all planning authorizations require planning obligations. A Section 106 agreement is the most common form of planning agreement and is concluded pursuant to Section 106 of the Town and Country Planning Act 1990, also known as the “planning obligation.” Section 106 of the agreements are developed when it is considered that a development will have a significant impact on the territory, which cannot be mitigated by conditions related to a decision to approve the plan. Note: Practical advice on planning agreements should be read in conjunction with other practical references to infrastructure contributions. For example, new residential construction may put additional pressure on the social, physical and economic infrastructure that already exists in a given region. A planning obligation must reconcile the pressures resulting from this new development with improvements in the environment, so that development can make a positive contribution to the local space and the community as much as possible. It also requires the dedication of 119.24ha of conservation areas and the payment of endowment funds of approximately $1 million (plus indexation) in relation to this environmental corridor. The agreement also requires the developer to maintain the following facilities for a period of five years, as soon as they are concluded: Section 106 (S106) Agreements are legal agreements between local authorities and developers; These are linked to planning authorities and can also be characterized as planning obligations. The application and appeal process will only assess the viability of the need for affordable housing. It will not reopen other planning policy considerations or verify the benefits of the authorized plan. Planning agreements can be negotiated at both the local and national levels.
